Terms of Service

1. Acceptance of Terms
By downloading, installing, or using BRYKK (“the App”), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the App. These terms apply to all users of BRYKK, including admins, supervised members, and free or paid subscribers.
2. Description of Service
BRYKK is a family safety application that provides:
- Real-time location sharing with members of your chosen family group
- Saved places (both family-shared and personal) with arrival, departure, and homecoming alerts
- Custom homecoming messages with sender-controlled audience
- Family chat
- SOS button and crash detection
- Medical Card and lock-screen widget
- On-device translation in 18 languages
- Family Admin Panel with PIN protection, supervised mode for kids, and admin recovery
- Apple Watch and Apple TV companion apps
- Temporary location share links for non-BRYKK users
BRYKK runs entirely on Apple's iCloud (CloudKit) infrastructure. BRYKK does not operate its own servers, databases, or admin tools.
3. Eligibility
You must be at least 13 years of age to use BRYKK as an independent user. Users under 13 may participate only as supervised members of a family group with the consent and management of a parent or legal guardian. Users between 13 and 18 should use BRYKK with parental knowledge. By using BRYKK, you represent that you meet these requirements.
4. Your Apple Account
BRYKK uses your existing iCloud identity to sync data across your devices. There is no separate BRYKK account, password, or login. You are responsible for maintaining the security of your Apple ID, including using a strong password and enabling two-factor authentication. You are responsible for all activity that occurs on devices signed in to your Apple ID.
5. Family Groups
BRYKK is built around family groups. You may create or join a family group using a shared family code. By joining a family group, you consent to sharing your location data, saved family places, and chat content with the other members of that group.
You may leave a family group at any time using the Leave Family option in Settings, unless you have been marked as a supervised member by an admin (see Section 6). Leaving a family group immediately removes your location record from the family's CloudKit data.
Family codes should be treated as semi-private. Anyone with the code and the BRYKK app can join the family group. We recommend sharing codes only with people you actually want in your family.
6. Family Admin and PIN Protection
BRYKK includes a Family Admin Panel that lets designated admins manage the family group. Admin features include editing the family name, promoting other admins, marking members as supervised, removing members, and dissolving the family.
Admin actions are protected by a PIN that you set on your own device. The PIN is stored only as a salted hash in iOS Keychain. The PIN is never transmitted, never recoverable, and cannot be reset by BRYKK. If you forget your PIN, the only path to recovery is to remove yourself from the family and rejoin. Your local data (saved places, trip history, settings) stays on your device when you do this.
We strongly recommend that every family designate at least two admins to avoid being stranded. If the original creator of a family loses access, any other non-supervised member can use the “Recover Admin Access” flow to claim admin status. This is a permissive design intended to keep families functional. If somebody mistakenly claims admin, an existing admin can demote them.
7. Supervised Members and Parental Responsibility
Admins may mark family members as “supervised.” This is a parental control flag designed for children and dependents. Supervised members cannot leave the family on their own and must request removal from an admin.
Supervised mode is a tool to support parental supervision. It is not a substitute for parenting, and it does not guarantee any particular outcome. BRYKK does not verify the relationship between admins and supervised members and is not responsible for misuse of the supervised flag. Parents and guardians remain fully responsible for their children's use of the App, including configuring kid-appropriate settings such as turning off the “Show Custom Messages” toggle.
8. Custom Messages and User-Generated Content
BRYKK allows you to write custom homecoming messages for your saved places, send chat messages to your family group, and upload an avatar photo. This is user-generated content. By writing or uploading content, you agree to the following:
- You are solely responsible for what you write or upload. BRYKK does not pre-screen, moderate, edit, or store user content beyond delivery via Apple iCloud.
- BRYKK has no technical ability to view your content in real time. Because BRYKK operates no servers, we cannot read your custom messages, chat, or photos as they are sent.
- You will not use BRYKK to write or share content that is harassing, threatening, defamatory, obscene, sexually explicit toward minors, illegal, infringing on someone else's rights, or harmful to any family member.
- You acknowledge that recipients can disable custom messages via the “Show Custom Messages” toggle on their device, and that custom messages have a sender-controlled recipient picker.
- You agree not to use custom messages or chat for any commercial purpose, including advertising, spam, or solicitation.
- BRYKK reserves the right to take action against accounts found to be violating these content rules, even though BRYKK's technical ability to enforce is limited by the zero-server architecture. Reports of abuse should be sent to legal@brykk.app.
9. Subscriptions and Founding Memberships
BRYKK Safe (Free): Core safety features are free and will remain free. Includes real-time location, SOS, crash detection, family chat, custom homecoming messages, family places, the family admin panel, and the medical card. No trial period, no expiration.
BRYKK Life (Premium): Subscription tier with additional features such as real-time translation, extended trip history, weather and severe alerts, calendar integration, and more saved places. When one family member subscribes, all members of that family group receive the premium features. Subscriptions are billed through the Apple App Store and managed in your Apple ID subscription settings.
Founding Memberships: One-time purchases providing lifetime premium access. Founding memberships are non-transferable and tied to your Apple ID. They remain valid for as long as BRYKK operates as a service. All founding membership purchases are final and non-refundable. Your purchase directly funds the development of BRYKK.
Refunds: Standard subscription refunds are handled by Apple per their App Store refund policy. BRYKK does not directly process refunds for App Store purchases. Founding memberships are non-refundable.
10. Safety Features Disclaimer
BRYKK's SOS button and crash detection are designed to assist in emergencies but are not a substitute for calling 911 (or your local emergency number) directly. Crash detection uses accelerometer data and motion sensors and may not detect all types of accidents or impacts. Geofence-based arrival and departure alerts depend on GPS, Wi-Fi, and cell signal availability and may be delayed or missed in areas with poor coverage.
BRYKK does not guarantee emergency response times, accurate location data in all conditions, or successful delivery of any notification. Always call emergency services directly when possible. BRYKK is a supplementary safety tool, not a primary emergency communication system.
11. Translation Disclaimer
BRYKK's translation features use Apple's on-device translation framework. Translations are provided as-is and may contain errors. Pre-built medical and emergency phrases are included for convenience but are not certified medical translations. Do not rely solely on BRYKK translations for life-critical medical communication. Use a certified medical interpreter when one is available.
12. Medical Card Disclaimer
The Medical Card feature displays health information you provide (or that BRYKK reads from your Apple Health Medical ID). BRYKK does not verify the accuracy of medical information. You are responsible for keeping your Medical Card information current and accurate. Healthcare professionals should always confirm medical information with the patient or other authoritative sources before relying on it for treatment decisions.
13. Data and Privacy
Your data is stored on Apple's iCloud infrastructure and on your device. BRYKK does not operate servers that store your data. See our Privacy Policy for complete details, including the full list of what BRYKK can and cannot see.
14. Prohibited Use
You may not use BRYKK to:
- Track any individual without their knowledge and consent
- Stalk, harass, intimidate, or threaten any person
- Send harassing, abusive, defamatory, obscene, or harmful custom messages or chat
- Share family codes with people who are not actually members of your family
- Use the App for surveillance of non-consenting adults
- Violate any applicable local, state, federal, or international law
- Attempt to reverse-engineer, decompile, or extract source code from the App
- Interfere with or attempt to bypass BRYKK's security features
- Use the App to facilitate illegal activity of any kind
- Use the App for commercial purposes, including advertising, spam, or solicitation
- Misrepresent your identity or your relationship to other family members
15. Account Termination
You may stop using BRYKK at any time by leaving your family group and deleting the app from your devices. BRYKK reserves the right to take action against accounts found to be in violation of these Terms, including pursuing legal remedies for serious violations such as stalking, harassment, or illegal activity, even though BRYKK's practical enforcement ability is limited by the zero-server architecture.
16. Limitation of Liability
BRYKK is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
To the maximum extent permitted by law, BRYKK and its creator shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to:
- Your use of or inability to use the App
- Any failure of safety features (SOS, crash detection, location accuracy, notifications)
- The accuracy or content of user-generated messages, chat, or custom homecoming messages
- The actions of other family members, including misuse of admin privileges or supervised mode
- Loss or unauthorized access to your iCloud account
- Loss or compromise of your PIN
- Service interruptions caused by Apple iCloud, Apple WeatherKit, or other Apple infrastructure
- Any reliance on BRYKK as a substitute for professional medical, emergency, parental, or safety services
BRYKK is a supplementary tool. It is not a substitute for emergency services, parental supervision, or professional medical, legal, or safety advice.
17. Indemnification
You agree to indemnify, defend, and hold harmless BRYKK and its creator from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to your use of the App, your violation of these Terms, your violation of any rights of another person, or your user-generated content (including custom homecoming messages, chat messages, and avatar photos).
18. Governing Law and Disputes
These Terms are governed by the laws of the State of Missouri, United States, without regard to conflict of law principles. Any dispute arising from or related to these Terms or your use of BRYKK shall be resolved in the state or federal courts located in Jackson County, Missouri, and you consent to the personal jurisdiction of those courts.
19. Changes to Terms
We may update these Terms from time to time as BRYKK evolves. Continued use of BRYKK after changes are posted constitutes acceptance of the new Terms. Material changes will be communicated through the App or via email if you have provided one. The “Last updated” date at the top of this page reflects when the Terms were most recently changed.
